Ramps and a bridge cross the marsh and the Ashley River toward Charleston, roads West Ashley car accident lawyers know well

A wreck on US 17 in West Ashley can produce a city police report, a sheriff's report or a trooper's report. The street name alone may not tell you which. West Ashley belongs to the City of Charleston as one of its districts, yet some of the land there is unincorporated Charleston County. Learning which agency wrote the report is where West Ashley car accident lawyers start, because that answer decides where the file sits and which court hears any ticket.

Inside the city, the Charleston Police Department gives West Ashley a patrol team of its own. The Charleston Police Department's Patrol Division roster lists Team 4 as West Ashley. Outside city limits, a deputy or a state trooper may answer the call instead. Hold on to the report number and the officer's name from the scene, since both point to the agency that keeps the file.

Frost Law Group is a Summerville practice. Its lawyers are a married pair, Jack C. Frost and Tara L. Frost. At the Charleston School of Law, the Student Trial Lawyers Association had Tara as its Vice President. She also helped set up a Trial Advocacy Board there. Car crash claims from across Charleston County come to the office, West Ashley wrecks among them.

Frost Law Group offers a free, confidential consultation at (843) 419-6653. The person who answers is an attorney, never a call center operator, and one call binds you to nothing.

Patrol Team 4, Deputies and Troopers on a Report for West Ashley Car Accident Lawyers

Which agency sent the officer to your West Ashley crash? The top of the South Carolina collision report answers that, and in West Ashley the line can read three different ways. Frost Law Group can check that line first. It tells the firm where to request the full file and which officer to ask about a diagram or a missing witness.

Only countywide numbers exist in the Fact Book for the two agencies that work West Ashley's county pockets. The Charleston County Sheriff's Office investigated 2,282 collisions across the county in 2024, 22 of them fatal. The Highway Patrol investigated 1,497, 3 of them fatal. None of those rows counts West Ashley alone, because the Fact Book sorts crash work by county and agency, never by neighborhood.

Patrol Team 4 and the Records Office on Lockwood Boulevard

City officers assigned to West Ashley belong to Patrol Team 4, one of the teams the department runs from its headquarters at 180 Lockwood Boulevard. City reports come from the Charleston Police Department's Records Office in that same building. A deputy's or trooper's report lives with a different agency. So the agency line on the report decides which office to ask before anyone makes a trip.

Collecting a City Report in Person

A counter visit works when you already know the report came from city police. Bring the crash date, your identification and whatever case number the officer gave you. Frost Law Group can handle South Carolina accident report requests for clients. A deputy's report will not be on file at that counter, so a look at the agency line first can save a wasted visit.

Deputy and Trooper Reports From the County Pockets

A report written by a Charleston County deputy or a Post A trooper does not sit at Lockwood Boulevard. SCDMV sells a copy of any officer's report, whichever agency wrote it, and charges $10 through its website or on Form FR-50. The agency line at the top of the report shows where else a request can go. For the Highway Patrol, the Post A office and the Troop Six headquarters share one Northbrook Boulevard address in North Charleston.

Sheriff's Deputies and State Troopers in the County Pockets

On unincorporated West Ashley land, Section 56-5-1260 sends the driver's notice to the sheriff. The other option is the Highway Patrol office nearest the crash. Troop Six, Post A of the Highway Patrol covers Charleston and Berkeley counties, and its troopers write their own reports on the state form. Jack C. Frost served the Charleston County Sheriff's Office as a deputy, master deputy and detective before retiring from it. He knows how deputies document a scene and write a report. None of that gives a client any pull with the Sheriff's Office.

Traffic Rules a West Ashley Auto Attorney Applies on US 17 and Sam Rittenberg Boulevard

In SCDOT's 2024 traffic counts for Charleston County, SC 7 carries the name Sam Rittenberg Boulevard and SC 61 carries the name Ashley River Road. The same file shows I-526 ending at SC 7. It also names SC 461 Glenn McConnell Parkway on one stretch, and it lists Bees Ferry Road as S-57. Those official names help place a crash before anyone argues about fault. Each count station in the file covers the stretch between two named junctions.

SCDOT gives SC 461 a second name, Paul Cantrell Boulevard, on another stretch, and SC 171 carries two street names of its own. Wappoo Road is S-26, and Main Road is S-20. Frost Law Group handles auto collision claims across Charleston County on each of these corridors.

US 17 From Savage Road to the SC 61 Connector

SCDOT counted about 56,200 vehicles a day on US 17 from Savage Road to I-526 in 2024. Past I-526, toward West Oak Forest Drive, the estimate was 45,300. Beyond Oak Forest Drive, US 17 carried 37,400 to Wesley Drive and 40,500 from Wesley Drive to the SC 61 connector. Say a driver turns left from US 17 onto Savage Road and strikes your oncoming car. Savage Road, numbered S-1168, carried 9,000 vehicles a day from US 17 to Paul Cantrell Boulevard. The left-turn statute, Section 56-5-2320, obliges the turning driver to wait for any oncoming car already in the intersection. The same goes for one so close that turning would create an immediate hazard. Breaking that rule weighs heavily, yet comparative negligence can still split the fault between drivers. Photos of the turn lane and the other car's final position help show how the turn began.

Where I-526 Ends at SC 7

Interstate traffic arrives at a surface boulevard where I-526 ends. On I-526 between SC 461 and Leeds Avenue, SCDOT's 2024 estimate was 82,600 vehicles a day. Between SC 7 and SC 461, the interstate carried 33,700. SC 7 from US 17 to SC 61 carried 29,200. Section 56-5-1520 requires speeds reasonable for conditions, even under the posted limit, and it calls for slowing near intersections. A driver who carries interstate speed onto the boulevard may have broken that duty, and the proof decides whether that driver did.

SC 461 Where It Meets Bees Ferry Road

The SC 461 segment that begins at Bees Ferry Road carried 48,200 vehicles a day in SCDOT's 2024 count. Bees Ferry Road itself, route S-57, carried 25,500 between Glenn McConnell Parkway and US 17, and 15,800 between Ashley River Road and the parkway. Picture a driver who gets a green light and pulls into an intersection while another car is still clearing it. Section 56-5-970(A)(1) says traffic facing a green light must still yield to vehicles lawfully within the intersection when the light changes. A fresh green, in other words, does not license a collision. Frost Law Group can look for signal timing, witnesses and video to show who was already in the intersection.

Wappoo Road, Magwood Drive and SC 171

SC 171 carried 27,200 vehicles a day between SC 61 and SC 7 in 2024. Wappoo Road carried 11,500 from SC 7 to US 17. Magwood Drive, route S-1863, carried 18,400 between SC 61 and SC 461. A report may use the route number, the street name or both, and SCDOT's file ties the two together, which helps when a witness remembers only one of them.

Ashley River Road Toward the Dorchester County Line

SC 61 runs out of West Ashley and into Dorchester County, where SCDOT still calls it Ashley River Road. Between SC 461 and SC 7, the road carried 42,800 vehicles a day in 2024. Past SC 7, it carried 38,800 to SC 171 and 54,000 from SC 171 to Sycamore Avenue. The stretch from the Dorchester County line to Old Parsonage Road carried 17,700. Frost Law Group, based in Summerville, also handles car crash claims in Summerville and on the Dorchester end of this road.

Charleston County Agencies on the West Ashley End

On the Charleston County side, the investigating agency depends on whether the crash happened inside city limits. City officers from Team 4 work any portion inside the city. Deputies or troopers from Post A handle the unincorporated stretches. The same road can therefore produce reports from different agencies along one drive.

Dorchester County Agencies Past the Line

Across the line, the county changes and so does the chain of agencies. The Dorchester County Sheriff's Office takes unincorporated calls there. Highway Patrol coverage comes from Troop Six, Post B, which covers Colleton and Dorchester counties. An injury suit tied to that side may belong at the Dorchester County Courthouse in St. George, in the First Judicial Circuit. Charleston County sits in the Ninth, so a crash near the line needs its exact location pinned down.

Unincorporated Pockets and the Agency Questions a West Ashley Injury Lawyer Asks

A Charleston mailing address does not prove a West Ashley crash happened inside the city. The Census Bureau's address matching shows why. It places the county's West Ashley Magistrate, at 1720 Sam Rittenberg Boulevard, in Charleston County with no incorporated place at all. By contrast, 2095 Henry Tecklenburg Drive, home of Bon Secours St. Francis Hospital, matches inside the City of Charleston.

The city still treats West Ashley as one of its districts. City Council has a West Ashley Revitalization Commission, and it approved a master plan called Plan West Ashley. The city's planning list for the district also includes a 2014 Sam Rittenberg Vision Plan. Its stated charge is the long-term economic stability of West Ashley, pursued by revitalizing the district's unique character. The commission also serves as the steering committee for carrying out that plan, and the city has posted a 2023 implementation update. No Census population exists for West Ashley, because the Census Bureau does not treat it as a place. Frost Law Group can map a crash address against that patchwork before requesting any record. That patchwork is why West Ashley car accident lawyers treat the street address as a starting point and nothing more.

Two Addresses on Opposite Sides of the City Line

The magistrate's office and the hospital sit in the same part of town but answer to different governments. Even at these two addresses, the road out front may fall on either side of the line, so the agency line on the report is the check. Nothing in the street names reveals that difference. Only the exact location, checked against city boundaries, settles which agency the driver should have notified.

Questions That Pin Down the Right Agency

A lawyer starts with where the cars came to rest, down to the nearest cross street or business. Next comes the department name printed on the report and on any ticket. A photo of the officer's patrol car, if you took one, can also show the agency's markings. The court named on a ticket offers another clue, because city tickets go to the city's court. Frost Law Group can put those answers together before calling a records office, and it can recheck them if a second report turns up.

A City or County Vehicle in the Crash

In a pocket neighborhood, the vehicle that hit you may belong to the city, the county or the state. Each counts as a governmental entity for purposes of the South Carolina Tort Claims Act, and that law runs on its own clock. The right defendant depends on which public body owns the vehicle or maintains the road. A city garbage truck, a sheriff's cruiser and a state work truck can each point to a different public body.

Deadlines for Suing a Public Body

The Act sets a shorter default window than an ordinary injury suit, with one way to extend it. That extension comes with a receipt deadline of its own, and missing it keeps the shorter window in force. Frost Law Group can calendar both dates once it identifies a public defendant.

Two Years Without a Verified Claim

Section 15-78-110 sets two years as the base limit for suing. The count starts on the date you discovered the loss or could reasonably have found it. That is the rule when nobody filed a claim with the agency first. Section 15-3-40, the extension for injured minors, also applies to claims under this Act.

Three Years With a Verified Claim

Filing a verified claim with the agency, and doing it before suing, opens a third year. The catch, found in Section 15-78-80(d), is timing. The agency must be holding the claim no later than twelve months after that same discovery date. File it late, and the two-year rule stays in place.

Road Defects and Notice Under the Act

Section 15-78-60(15) shields public bodies from claims over highway design. A third party's defect becomes the responsible body's problem only after that body knew of it, actually or constructively. Even then, it must have let an unreasonable stretch of time pass without a fix. A complaint log or a work order can help show when the public body learned of the defect.

Bon Secours Records and Med Pay Questions for a West Ashley Car Wreck Attorney

Bon Secours St. Francis Hospital lists 190 inpatient beds and 24/7 emergency services at its Henry Tecklenburg Drive campus. The Department of Public Health's trauma list does not include it. A hospital's trauma status and a crash victim's claim are separate questions, though, and the chart matters either way.

Frost Law Group can build the medical file around every facility that treated you, in the order you saw them. Each hospital keeps its own records and billing, so each one needs its own request. A follow-up visit to a doctor's office creates one more file to gather.

Bon Secours St. Francis Hospital on Henry Tecklenburg Drive

The hospital sits inside the City of Charleston, according to Census Bureau address matching. That location says nothing about where your crash happened or which agency worked it. A lawyer requests the emergency chart along with imaging, lab results and the discharge papers. The complete chart matters more than a summary, since a summary can leave out the triage notes. An admission, rather than an emergency visit alone, adds nursing notes and consult reports to the file. The itemized bill is the next request.

Paying Bills Before the Claim Resolves

Medical bills start arriving long before any settlement discussion, and two statutes shape who pays first and who gets repaid. Frost Law Group can review your policies early for that reason, including any policy a spouse or relative in your home carries. The answers depend on the policy language and on where the policy was written. Your own declarations page and your health plan booklet are the place to start.

Medical Payments Coverage Under Section 38-77-144

No South Carolina law requires personal injury protection, often called PIP. Med pay, short for medical payments coverage, is an optional add-on. Under Section 38-77-144, med pay cannot be assigned. It also carries no subrogation right, so your insurer cannot claim repayment of it from your injury recovery. Nor is it subject to setoff, which means no one may subtract it from what another insurer owes you. Section 38-77-260 adds a protection. An insurer paying med pay cannot get a release or repayment agreement from you unless it first delivers a disclosure statement and waits at least three days.

Health Plan Repayment Under Section 38-71-190

Section 38-71-190 lets a health policy written in South Carolina carry a subrogation clause. That clause reaches no further than what the plan already paid for injuries the at-fault driver caused. On the insured's petition, the Director of Insurance can refuse the repayment when it would be inequitable and unjust. Attorneys' fees and costs come out of whatever the insurer recovers, and the statute puts that cost on the insurer.

Ticket Court, Magistrate or Broad Street for a West Ashley Car Crash Lawyer

The West Ashley Magistrate, at 1720 Sam Rittenberg Boulevard, Unit 11, is a Charleston County court. Section 22-3-10 keeps magistrates to civil disputes worth $7,500 or less. A West Ashley crash with real medical bills usually exceeds that limit. Most injury suits therefore look past the magistrate.

Where the crash happened decides which traffic court hears any ticket, the city court on Lockwood Boulevard or a county magistrate. Frost Law Group can match each piece of the dispute to the court that can hear it. For wrecks on the peninsula and elsewhere in the city, the firm also handles Charleston injury claims from the same office.

Ticket Cases at the City Court on Lockwood Boulevard

Tickets written by city officers go to the City of Charleston Municipal Court at 180 Lockwood Boulevard. According to the Judicial Branch, a municipal court cannot take a civil case of any size, so the injury claim never lands there. Its criminal reach stops at offenses punishable by up to $500 or 30 days. A ticket written in a county pocket generally goes to a county magistrate instead. Either way, the ticket case runs apart from your claim. The ticket's outcome and your claim can differ, since each rests on its own proof.

Injury Suits at 100 Broad Street

A West Ashley injury suit usually goes to Common Pleas, and Charleston County's courthouse for that court stands at 100 Broad Street. The Ninth Judicial Circuit serves Charleston County together with Berkeley County. Filings go through the Clerk of Court's office in Suite 106 of the same building. Tara L. Frost's bench experience in Dorchester County, where she served as a magistrate judge until August 2025, taught her how evidence and credibility get weighed. She brings that perspective to preparation, not to any promise about a result.

Bringing Your Own Uninsured Motorist Carrier Into the Suit

Uninsured motorist coverage is mandatory on every South Carolina auto policy, a rule found in Section 38-77-150. Underinsured coverage is optional, though insurers must offer it. A claim against either one adds a step once suit is filed. The suit papers go to that carrier, and it gets 30 days to appear. Frost Law Group can check your declarations page for both coverages before filing. They can matter when the other driver carried little or no insurance.

Does the Property Damage Deadline Match the Injury Deadline?

Both run three years under Section 15-3-530, but they start differently. The injury clock starts on the date you discovered the injury claim, or the date reasonable diligence would have revealed it, under Section 15-3-535. That discovery rule applies only to injury claims, not to the claim for your damaged car. A lawyer tracks both dates, because the two claims can fall on different calendars.
